1. Agreement and Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you and Aphelion Pvt. Ltd. ("Aphelion," "Company," "we," "our," or "us"), a private limited company incorporated under the Companies Act, 2013, with its registered office in Hyderabad, Telangana, India. These Terms govern your access to and use of the Maleu mobile application and associated web services at maleu.online and aphelion.life (collectively, the "Platform").

To be eligible to use the Platform, you must be at least 18 years of age. By registering for an account, you represent and warrant that you are 18 years old or older, and have full legal capacity to enter into a binding contract under the Indian Contract Act, 1872. You may maintain only one personal account on the Platform.

2. Account Security and Deletion

You are responsible for keeping your login credentials confidential. You are fully responsible for all activities that occur under your account. You must notify us immediately at fuy.aphelion@gmail.com of any unauthorized use.

You have the right to delete your account at any time. The account deletion pathway is available within the app under: Profile Page → Settings → Delete Account. Upon initiation, your account will be deactivated and hidden from public view. After a 15-day grace period, all your data, posts, messages, and media files will be permanently and irreversibly purged from our active systems.

3. User-Generated Content and Intellectual Property

You retain all ownership rights in the content you create and post on Maleu (including text, photos, video clips, and workout logs). By posting, you grant Aphelion a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, display, distribute, transmit, and reproduce your content solely for the purpose of operating, providing, and improving the Platform.

Mandatory AI-Generated Content Disclosure: You are permitted to post AI-assisted or AI-generated text and media. However, you must clearly and prominently label such content as "AI-generated" or use equivalent clear disclosure within the post caption so it is easily visible to other users. Failure to disclose is a material violation of these Terms.

4. Zero Tolerance and Prohibited Conduct

We maintain a zero-tolerance policy against harmful, offensive, or illegal behavior. You strictly agree not to post or transmit content that:

• Depicts or facilitates Child Sexual Abuse Material (CSAM) or exploits children in any way.
• Includes Non-Consensual Intimate Imagery (NCII) or non-consensual deepfakes.
• Promotes, glorifies, or recruits for terrorism, extremist violence, or real-world physical harm.
• Harasses, bullies, stalks, or doxxes any other individual (including private addresses, phone numbers, or daily locations).
• Impersonates any individual or entity, or is designed to facilitate scams, fraud, or spam.

Violators are subject to immediate content removal, warning strikes, account deactivation, or a permanent ban, without a right of recovery. Serious violations will be reported to Indian law enforcement.

6. Limitation of Liability and Indemnification

The Platform is provided "as is" and "as available" without warranties of any kind. To the maximum extent permitted under applicable Indian law, Aphelion, its directors, and employees shall not be liable for any indirect, special, incidental, or consequential damages, or any loss of profits, data, or goodwill. In no event shall our total aggregate liability exceed INR 10,000 (Indian Rupees Ten Thousand).

You agree to indemnify and hold harmless Aphelion and its representatives from any third-party claims, liabilities, or expenses arising from your use of the Platform or your breach of these Terms.

7. Governing Law and Dispute Resolution

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of India. Any disputes, claims, or controversies arising under or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana, India.
